Your privacy is important to PHILYRA® and we take all necessary steps to ensure that the personal information you share with us is protected at all times.

We gather and process your personal information in accordance with this privacy notice and ongoing compliance with the relevant National and European data protection Regulation and laws, namely the Data Protection Act 2018 and the GDPR, effective as of 25th May 2018. 

This Privacy Policy describes in detail the types of personal data we may collect about you when you use our website; for example, when you contact us about our products, when you create an account and make a purchase and if you choose to receive our email newsletters. It also explains your rights and our obligations in relation to handling, storing and keeping your information safe.

What information do we collect about you?

PHILYRA® processes your personal information to meet our legal, statutory and contractual obligations and to provide you with our products and services. We will never collect any unnecessary personal data from you and do not process your information in any way, other than as specified in this notice.

The information we collect includes:

  • your name, title, date of birth, telephone number, email and postal address. Such information is required for us to fulfil your order.You may also choose to provide us with additional personal information (for a custom order of jewellery, for example), if you contact us directly.

Other information we collect might include:

  • your IP address, information about pages you access and requests you make on our website, information regarding the devices you use to access our website and services, the make,model and operating system, browser type and mobile device identifiers.
  • information in relation to your online purchases e.g. what you have bought, when you bought it and the method it was paid with.
  • information about your online browsing behaviour on our websites including when you click on one of our adverts or those shown on other organisations’ websites.

When you contact us or we contact you with promotions, competitions or reviews about our services, we may collect:

  • Personal data you have  voluntarily provided when you have contacted us about our services e.g. name, username and contact details.  This can come via email or correspondence through social media.
  • Details of the emails and other digital communications we send to you that you open, including any links in them that you click on.
  • Your feedback on our services to our customer service representatives.

 Please note that we do not keep a record of the debit/credit card details you enter online when you make a purchase on our website.

Why do we need your information and how will we use it?

We rely on a number of legal bases to collect, use, and share your information, including:

  • when you have provided your affirmative consent, which you may revoke at any time, such as by signing up for our mailing list;
  • if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; 
  • as necessary for the purpose of our legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as providing and improving our services. We use your information to provide the services you requested and in our legitimate interest to improve our service. 

Marketing and communications

Occasionally, PHILYRA® would like to send you information about special offers, products and services that we think will interest you. For this purpose we offer the option to subscribe to email newsletters. This is not required, and you can opt out of receiving these at any time.

If you do choose to receive email newsletters, we will ask for your email address and your consent to contact  you. The newsletters we send will contain details of promotions, special offers, product launches etc. If you have placed orders with us, we will use that data to ensure you receive emails  with content that is relevant to you (for example featuring types of products and offers that we think you will be interested in, offers available in your country, etc.).

We also like to hear your views to help us to improve our products and services, so we may contact you for market research purposes. You always have the choice about whether to take part in our market research and you may withdraw your consent to receive marketing information from us by using the opt-out /unsubscribe options or by contacting us in writing at any time.

Information sharing and disclosure

Information about our customers is important to our business. We may share your personal information for very limited reasons and in limited circumstances, as follows:

 Service providers

We engage certain trusted third parties to perform functions and provide services to our business, such as delivery companies. We will share your personal information with these third parties, but only to the extent necessary to perform these services.

All processors acting on our behalf only process your data in accordance with instructions from us and comply fully with this privacy notice, the data protection laws and any other appropriate confidentiality and security measures.

Shopify Payments & PayPal Express Checkout are our online payment gateway who perform our security checks and act as a processor on our behalf. Google analytics tracks customer behaviour and is used in order to help us personalise our services and marketing to our customers. For more information surrounding Google, please read their Privacy Notice.

 Business transfers

If we restructure, sell or transfer our business (or part of it). We may disclose your information as part of that transaction, only to the extent permitted by law.
 
Compliance with laws
We may collect, use, retain, and share your information if we have a good faith belief that it is reasonably necessary to:
  1. respond to legal process or to government requests
  2. enforce our agreements, terms and policies
  3. prevent, investigate, and address fraud and other illegal activity, security, or technical issues or
  4. protect the rights, property, and safety of our customers, or others.

Safeguarding measures

PHILYRA® takes your privacy seriously and takes every reasonable measure and precaution to protect and secure your personal data. We work hard to protect you and your information from unauthorised access, alteration, disclosure or destruction and have several layers of security measures in place, including:

  • Physical, electronic and procedural safeguards in connection with the collection, storage and disclosure of personal data;
  • We protect the security of your information while it is being transmitted by encrypting it;
  • We use computer safeguards such as firewalls and data encryption to keep this data safe;
  • We only authorise access to employees and trusted partners who need it to carry out their responsibilities;
  • We regularly monitor our systems for possible vulnerabilities and attacks, and we carry out penetration testing to identify ways to further strengthen security;
  • We will ask for proof of identity before we share your personal data with you.

Cookies

We may use technology to track the patterns of behaviour of visitors to our site. This can include using a cookie internet file, a small file that is sent by our web server to your computer, which we can access when you make return visits to our website.

Category 1: strictly necessary cookies
These cookies are essential in order to enable you to move around the website and use its features, such as accessing secure areas of the website. Without these cookies services you have asked for, like shopping baskets or e-billing, cannot be provided.

These cookies collect information about how visitors use a website, for instance which pages visitors go to most often, and if they get error messages from web pages. These cookies don’t collect information that identifies a visitor. All information these cookies collect is aggregated and therefore anonymous. It is only used to improve how a website works.

How long we keep your data for

We retain your personal information only for as long as necessary and we have strict review and retention policies in place to meet our legal and regulatory obligations. We are required under UK tax law to keep your basic personal data (name, address, contact details) for a minimum of 6 years after which time it will be destroyed.

Where you have consented to us using your details for direct marketing, we will keep such data until you notify us otherwise and/or withdraw your consent.

Transfers of personal information outside the EU

We may store and process your information through third-party hosting services in the US, Europe and other jurisdictions. As a result, we may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If we are deemed to transfer information about you outside of the EU, we rely on Privacy Shield as the legal basis for the transfer, as Google Cloud is Privacy Shield certified.

Consequences of not providing your data

You are not obligated to provide your personal information to PHILYRA®. However, as this information is required for us to provide you with our services , deliver your products and legitimate interests, we will not be able to offer our services without it.

Your rights

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. We describe these rights below:
Access
You may have the right to access and receive a copy of the personal information we hold about you by contacting us using our contact form.

 

Change, restrict, delete
If you believe that we hold any incomplete or inaccurate data about you, you have the right to ask us to correct and/or complete the information and we will strive to do so as quickly as possible; unless there is a valid reason for not doing so, at which point you will be notified. You may also have rights to restrict our use of, or delete your personal information. Absent exceptional circumstances (like where we are required to store data for legal reasons) we will generally delete your personal information upon request.

 

If we receive a request form you to exercise any of the above rights, we may ask you to verify your identity before acting on the request; this is to ensure that your data is protected and kept secure.

 

Object
You can object to :
  1. our processing of some of your information based on our legitimate interests and
  2. receiving marketing messages from us after providing your express consent to receive them.
In such cases, we will delete your personal information unless we have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.

 

Complain
If you reside in the EU and wish to raise a concern about our use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority. In the UK that is the Information Commissioner's Office (ICO).

Changes to this privacy policy

This privacy policy is effective as of July 2020 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.

We reserve the right to update or change our privacy policy at any time and you should check this section periodically.
